Recent Interesting Trials

  • Indecency with a Child Case (2009)- Client had case presented to Grand Jury. Benge and Shields assisted the client in presenting his side of the case to the Grand Jury and created juror packets with relevant information. Presentation resulted in the charges being dismissed and the case being given a “No Bill”.
  • State v. Barrera – All charges were dismissed after a Motion to Suppress was filed and granted in District Court. The Court held that the search was illegal and that the search warrant was invalid.
  • State v. Osbourn – obtained a settlement of deferred probation on Failure to Stop and Render Aid while the Defendant’s Intoxication Assault charge was dismissed.

  • Obtained probation on a sex offender case where the Defendant had two prior felony convictions and was ineligible for probation from a jury.

  • State v. Young (May 2006) –  The charge was Aggravated Robbery.  The jury convicted of straight robbery instead and find that a deadly weapon finding had not been proven.
  • State v. Valencia (August 2006)-  The charges were Aggravated Robbery, Aggravated Assault and Aggravated Assault.  The jury found Defendant not guilty of Aggravated Robbery, not guilty of the first Aggravated Assault and guilty on the third count only.
  • State v. Apgar (December 2006) –  The defendant was charged with Murder.  The charges were reduced to Manslaughter and the defendant went to the jury for punishment in a jury trial.  The jury gave defendant 5 years in prison.
